Terms of service
1. Validity
These terms govern the sale and supply of products by SPECTRUM to you. SPECTRUM may modify these terms in the future. Any modifications to the current terms will be communicated via email to registered users and will take effect immediately upon publication on the website.
2. The Contract Between You and SPECTRUM
No commitment exists between you and SPECTRUM until SPECTRUM sends you an email confirming the receipt and acceptance of your order. SPECTRUM reserves the right to withdraw from any commitment in the event of evident errors or inaccuracies concerning the goods or orders displayed on the SPECTRUM website.
3. Prices and Availability
The prices of SPECTRUM products are clearly indicated on the website and include VAT. In addition to the product price, a shipping fee will be added, which varies depending on the quantity and weight of the total order, as well as the delivery method. The data relating to price and availability on the SPECTRUM website are subject to change without notice, but the payment will be based on the price indicated at the time of ordering.
4. Delivery
SPECTRUM will deliver the products ordered to the address provided by you during the order confirmation. All delivery times indicated on SPECTRUM are estimates based solely on normal order processing and delivery times as declared by the carriers. The couriers used do not make preliminary phone calls nor do they handle requests for deliveries at specific times. Generally, without this being a binding condition for SPECTRUM and subject to any events of force majeure, the goods will be delivered by SPECTRUM to the courier within 24 hours (working days).
5. Liability
SPECTRUM is not liable for any disruption due to force majeure events such as accidents, explosions, fires, strikes, lockouts, earthquakes, floods, or other similar events that prevent, in whole or in part, the execution of the shipment within the agreed timeframe. SPECTRUM shall not be liable to any party for damages, losses, or costs incurred as a result of the failure to execute the contract due to the aforementioned causes, with the consumer being entitled only to the refund of the paid price. Likewise, SPECTRUM is not liable for any fraudulent or unlawful use by third parties of checks or other means of payment at the time of payment for purchased products.
6. Right of Withdrawal
The customer has the right to withdraw, without any penalty, within 14 days of delivery. The right of withdrawal must be exercised within the prescribed period, upon authorization request to [email protected]. Return shipping costs and management are the customer's responsibility. After the return authorization is confirmed, you have 10 days to hand the goods over to the courier; otherwise, the return terms will expire, and you will no longer be entitled to any refund. Returned products must be unused, intact, not worn or stained, in their original packaging, complete with tags, and all other parts. Failure to comply with these conditions makes the right of withdrawal inapplicable. In the case of a refund, the same payment method will be utilized for the order. The issuance of the refund may take up to 14 days. Once the goods are received and verified, SPECTRUM will calculate the refund value and communicate it to the customer. The base refund amount will correspond to the sum of the purchase prices of the returned products. If a discount coupon is used, the discount component relating to the returned products will be deducted from the base refund amount. Discount coupons are never refundable. Please note: if the right of withdrawal does not apply, the products will remain at our premises. It is the customer's responsibility to arrange a shipment for the collection of the goods at their expense.
7. Obligations of the Purchaser
The consumer agrees and undertakes, once the "online" purchase procedure is completed, to print and retain these general terms and conditions, which they will have already viewed and accepted at the time of registration and/or order confirmation.
7.1 These general terms may be updated or modified at any time by SPECTRUM, which will notify users via email. The consumer agrees to print and retain the revised terms each time they are updated.
7.2 The purchaser is strictly prohibited from providing false, invented, or fictitious data during the purchase or registration. The personal details and email address must be their real data, not those of third parties or fictitious characters. Double registrations corresponding to a single person or providing third-party data are expressly prohibited. SPECTRUM reserves the right to take legal action for any violations or abuse, in the interest of and to protect all consumers.
7.3 The customer indemnifies SPECTRUM from any liability arising from the issuance of incorrect fiscal documents due to errors in the data provided by the customer, who is solely responsible for correctly entering such data.
7.4 In compliance with Article 3, paragraph 4, of Law No. 94 of July 15, 2009, the sale of non-biodegradable sprays to minors under the age of 18 is prohibited. Since SPECTRUM cannot verify the accuracy of the data provided and the actual age of our customers, the purchaser assumes full responsibility by implicitly declaring, through order confirmation, that they are of legal age.
8. Applicable Law and Jurisdiction
Contracts between you and SPECTRUM will be subject to Italian law, and all disputes will fall under the jurisdiction of the Court of Pavia.
